All employees have rights, and if you feel yours have been violated, give our employment law attorney a call to discuss the circumstances. There are federal employment laws that guarantee your rights, including laws against discrimination and harassment; and against retaliation for filing a complaint against an employer (whistleblower rights). All employees have the right to fair wages for the work they have done (fair compensation). Even people who are applying for a job have rights before ever being hired, most importantly the right to be free from discrimination.

Here are the federal employment laws prohibiting job discrimination:
  • The Civil Rights Act of 1964 makes it illegal to discriminate in the workplace on the basis of race, gender, color, religion, national origin or sexual orientation.
  • The Equal Pay Act of 1963 (EPA) protects against discrimination in how much women are paid, compared with men, if they are doing substantially the same job. Think of it as equal pay for equal work.
  • The Age Discrimination in Employment Act of 1967 (ADEA) covers employees who are 40 years old or older.
  • Federal employment laws under the Americans with Disabilities Act of 1990 (ADA) prohibit job discrimination against a qualified person on the basis of an actual disability or a perceived disability.
  • The Rehabilitation Act of 1973 protects US government employees with disabilities against workplace discrimination. Disability discrimination has become a major issue in the modern work environment.

Call our office if you feel your employer or supervisor has violated any of those protections. There are additional federal employment laws.
  • The Family Medical Leave Act (FMLA) allows for employees to take unpaid leave following the birth or adoption of a child, when an immediate family member is seriously ill, or when the employee is suffering a serious medical condition. The FMLA requires that the employee get the same job back (or an equivalent job) when the leave is over.
  • Wrongful termination: If you lost your job for what you believe to be an unlawful reason, call our offices to speak with an employment law attorney. You may have a wrongful termination claim against your former employer. If you believe you are about to be fired or laid off for unlawful reasons, fair severance may be negotiated with the help of an attorney.

Additional federal employment laws cover sexual harassment; ERISA (pension plans); and unemployment benefits. Call about the circumstances in your workplace. We represent federal employees in filing claims, and appeals, including before the Merit Systems Protection Board (MSPB) and DOHA (Defense Office of Hearings and Appeals).
